The idea of federalism is a way of eliminating the disadvantages of both systems. In a federal system, power is shared by the national and state governments. There are two major historical events that have been as a result of federalism. They include
- The Civil War
- the Fourteenth Amendment
The American Civil war
The American Civil War was a civil war in the United States between the United States and the Confederacy.
The remote cause of the war was due slavery rights, especially the expansion of slavery into territories acquired as a result of the Louisiana Purchase and the Mexican–American War.
The civil war was one of the major fallouts of federalism because states wanted to decide for themselves if they would permit slavery or not.
The Fourteenth Amendment
The fourth Amendment to the United states constitution states that No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
This legislation aims at conflicting the idea of federalism and as such it has prove to be a constant source of conflict
