The Constitution grants rights such as:

  • freedom of speech
  • right to fair trials
  • protection of land

By mentioning them, the Constitution grants Americans these rights. This does not mean however, that it can enforce them simply by mentioning them.

The framers of the Constitution realized that they could not enforce these rights by merely stating them so it mandated certain arms of government to do so which are:

  • the executive arm
  • the judicial arm

We can conclude therefore, that the difference between the Constitution granting rights and protecting them is that the Constitution does the former on its own but leaves the latter for other arms of government to do.
