The issues with Affirmative Action come from its inability to help the people who really need it but are too poor to even have the resources to be in a position to use it while people who benefit from it sometimes do not need it or have a  generation that used affirmative action and no longer needs it.
The court uses background checks and aptitude tests for the same which does not entirely make sense. Instead a measure of disadvantages in resources can be calculated to give a better picture.
