King establishes first a difference between just and unjust laws and then states that the individual has a moral responsibility to follow just laws and to disobey unjust laws. In his letter from Birmingham jail, Dr. Martin Luther developed his claim that one had a moral responsibility to obey unjust law by explaining what he meant by the term.

He described unjust laws are laws that are enforced on a minority group yet the same people enforcing the laws are not bound by the law.

According to him an unjust law is not a moral law, it is against natural law and the eternal law. Therefore people are not obligated to just fold their hands and obey such laws.

An example of the unjust law was the law that excluded the blacks from voting.
