C, aged 21 and in her final year at university, is swimming in a council swimming pool. She suffers cramp and starts to drown. The lifeguard employed by the council is not at his post. C is eventually rescued but has suffered brain damage and will need constant care. It is possible that, if the lifeguard had been there, she would have been rescued in time to prevent the brain damage.
